Booking terms

1. Provider and scope
The accommodation provider is van Hoorn & van Hoorn Immobilien GbR, Siedlerstraße 20, 26789 Leer, Germany, represented by Christian van Hoorn. These terms apply to direct bookings of Ferienhaus Siedlerstraße and Sunrise Apartment Leni through this website. Bookings through Airbnb are subject to the terms agreed there.
2. Booking and confirmation
Availability and prices appear in the Smoobu booking form. Before placing a paid booking, check the accommodation, dates, number of guests, services and total price. Submitting the paid booking constitutes a binding offer. The contract is formed when we expressly confirm the booking; a mere acknowledgment of receipt is insufficient.
Individual agreements take precedence. Please contact us promptly if the confirmation contains incorrect details.
3. Prices and additional charges
The total price displayed before completion applies to the chosen dates and guest count. Cleaning charges and agreed supplements are shown in the booking form. Any local charges are disclosed before completion, including any payment due on arrival.
Website base rates per night are currently 10% lower than the corresponding Airbnb base rates. There is no additional weekly discount. Platform fees, local charges, extra services and other discounts may result in a different percentage difference in the total price.
4. Deposit and balance
A deposit of 30% of the total price is due within 7 calendar days after booking confirmation. The remaining 70% is due no later than 30 days before arrival. For bookings made 30 days or less before arrival, the full amount is due immediately after confirmation.
You can pay by PayPal or bank transfer. Bank details for a transfer are provided with the confirmation. Late payment does not automatically cancel your booking; we will contact you about the outstanding amount. Statutory rights remain unaffected.
5. Cancellation and early departure
Cancellation is free of charge until 30 days before arrival. Payments already made will be refunded. The date we receive your cancellation determines the deadline; you can email fewo.vanhoorn@gmail.com.
For later cancellation, failure to arrive or early departure, a flat cancellation charge of 90% of the accommodation cost for unused nights applies. Cleaning and other extra services not provided will not be charged. Saved expenses and revenue from a replacement booking are credited insofar as they are not already reflected in the flat charge. You may prove that no loss or a lower loss occurred, in which case only that amount is charged. Payments already made are credited and any excess is refunded.
Statutory rights to withdraw, reduce the price or terminate remain unaffected.
6. Arrival, occupancy and use
Ferienhaus Siedlerstraße: up to 5 guests, arrival from 3 pm, departure by 10 am. Sunrise Apartment Leni: up to 3 guests, arrival from 3 pm, departure by arrangement. Different arrangements may be agreed individually. Our colleague Vladimir handles on-site support and guest registration at Leni; contact details will be supplied before arrival.
Only the agreed number of guests may stay. Please agree any additional overnight guests with us beforehand. Treat the accommodation and equipment with care and observe house rules communicated before booking. Report damage or defects promptly so that we can assist. Statutory rules on liability apply.
7. Withdrawal and local rules
Where German law applies, holiday accommodation booked for specific dates is excluded from the statutory 14-day withdrawal right under section 312g(2)(9) of the German Civil Code. The cancellation option agreed above remains available.
Mandatory provisions of the applicable law remain unaffected. Local rules in Montenegro also apply to Leni, including any required guest registration and local charges. We will provide the necessary information before booking.
